Public Hearing Notices

Public Hearings are part of formal government meetings and are scheduled as needed. Public Hearings are opportunities for a governing body to receive testimony from the public at large on local issues or proposed government actions. Notices are posted here and published in The Winchester Star — the area’s newspaper of record — at least 10 days prior to the Public Hearing.

 

Public Hearing: BZA-23-01 Whyte

The Clarke County Board of Zoning Appeals will conduct a Public Hearing in the Berryville-Clarke County Government Center second-floor meeting room, 101 Chalmers Ct., Berryville, Va., on Monday, April 24, 2023, at 10 a.m. or as soon thereafter as the matter may be heard to consider the following item:

BZA-23-01. Sean D. and Amy C. Whyte (owners/applicants) are appealing the Zoning Administrator’s Notice of Violation & Correction Order, dated Feb. 9, 2023. This Notice of Violation determines the use of 436 Timber Lane (Bluemont, VA 20135) to be in violation of Section 5.2B of the Clarke County Zoning Ordinance for the operation of a Short-Term Residential Rental. Section 5.2B prohibits Short-Term Residential Rentals in the RR (Rural Residential) Zoning District, in which the property is zoned. The application includes a Statement of Justification from the applicant. The subject property is identified as Tax Map #17A1-2-67 (including adjacent lots) and located within the Buckmarsh Election District.

Any person desiring to speak on the above matter should appear at the appointed time and place. Written copies of statements are requested but not required. Clarke County does not discriminate on the basis of handicapped status in admission to its programs and activities. Accommodations will be made for handicapped persons upon prior request.
