PUBLIC HEARING NOTICE
The Clarke County Board of Zoning Appeals will hold a public hearing on April 19, 2021, at 10 a.m. or as soon thereafter as the matter may be heard, in the Berryville-Clarke County Government Center, Main meeting room second floor, 101 Chalmers Ct., Berryville, Va., to consider the following matter:
BZA-21-01. Brian Legge (owner/appellant) is requesting a variance to allow “his completed garage that is located approximately fourteen (14) feet within the setback area adjacent to Route 340 to continue to exist in its current location.” A permit was issued that required that the garage to be no less than 50 feet from the edge of the right-of-way to Rt. 340. However, the garage was constructed only 35.9 feet from the edge of this right-of-way. The subject property consists of approximately 1 acre within the RR (Rural Residential) Zoning District and H (Historic) Overlay District. The property is identified by Tax Map #28A-A-66, and the existing house on the property is addressed as 140 White Post Road. §3-A-3-c of the Clarke County Zoning Ordinance includes the minimum setback requirements for properties within the RR District.
