PUBLIC HEARING NOTICE

The Clarke County Board of Zoning Appeals will hold a public hearing on April 19, 2021, at 10 a.m. or as soon thereafter as the matter may be heard, in the Berryville-Clarke County Government Center, Main meeting room second floor, 101 Chalmers Ct., Berryville, Va., to consider the following matter:

BZA-21-01.  Brian Legge (owner/appellant) is requesting a variance to allow “his completed garage that is located approximately fourteen (14) feet within the setback area adjacent to Route 340 to continue to exist in its current location.”  A permit was issued that required that the garage to be no less than 50 feet from the edge of the right-of-way to Rt. 340.  However, the garage was constructed only 35.9 feet from the edge of this right-of-way. The subject property consists of approximately 1 acre within the RR (Rural Residential) Zoning District and H (Historic) Overlay District.  The property is identified by Tax Map #28A-A-66, and the existing house on the property is addressed as 140 White Post Road.  §3-A-3-c of the Clarke County Zoning Ordinance includes the minimum setback requirements for properties within the RR District.

Information regarding the above matter is available to the public at the Clarke County Department of Planning during regular business hours. Any person desiring to speak on the above matter should appear at the appointed time and place.  Written copies of statements are requested but not required.  Clarke County does not discriminate on the basis of handicapped status in admission to its programs and activities.  Accommodations will be made for handicapped persons upon prior request.
