The laws governing open burning in Virginia are:

1) Between February 15th and April 30th:
  • No burning until after 4:00pm if within 300 ft of woodland or grass and brushland leading into woodland.
  • Fire must be attended at all times if within 150 ft of woodland or grass and brushland leading into woodland.
  • No fuel may be added or fire rekindled after midnight.
  • Law applies to camp fires, warming fires, brush piles, household trash, stumps, fields of broomstraw and brush, or anything capable of spreading fire.
2) Between May 1st and February 14th:
  • There is no restriction as to time of day (4pm rule does not apply).
  • Fire must be attended at all times if within 150 ft of woodland or grass and brushland leading into woodland.

Any open burning must be reported to Clarke County Central Communications at 540 955 1234 immediately prior to start of burn.
